Minimum Age Requirements

Minimum check-in age is 21 and a valid government photo ID is required.

Cancellations

Reservations must be canceled 48 hours prior to arrival to avoid being charged a penalty. A minimum penalty of one night’s room and tax will be charged if a reservation is canceled after the specified cancellation time. Prepaid reservations and deposits are nonrefundable and cannot be canceled without forfeiting the entire amount of the stay or deposit unless specified otherwise. Exceptions may apply during holiday, special events and conventions.

Reservation Changes

Please note that a change in length of stay or dates (based upon availability) of your reservation may result in a rate change and/or may not be available based on length-of-stay restrictions. Kixby has two payment policies depending on which rate you choose to book. All reservations except for prepaid bookings adhere to the Global Guarantee Policy.

Global Guarantee Policy

All reservations must be guaranteed with a valid major credit card at the time of booking.

We reserve the right to cancel any reservation that is not booked with a valid major credit card.

Guest must present a valid major credit card in his or her name upon arrival at the hotel, at which time a credit card authorization will be processed to cover all charges. A sufficient amount of credit must be available to cover all room charges, taxes and incidental charges. Presenting a debit card upon arrival will result in a hold (temporary charge) on your account for the amount authorized.

Cash payment will be accepted upon checkout, at which time the credit/debit card authorization will be released. Once an authorization has been released, the credit/debit card issuing bank will determine when your funds can be made available.

Prepaid Guarantee Policy

The credit/debit card provided for this reservation will be charged for the full amount of the stay plus tax, and this charge is nonrefundable. Please ensure that you have sufficient credit/funds available to cover the charges for your stay. We will be unable to honor any reservation that is made with an invalid credit/debit card or a credit/debit card with insufficient credit/funds available.

Guest must present a valid major credit card in his or her name upon arrival at the hotel as a security deposit and to cover incidental charges. A credit card authorization will be processed and a sufficient amount of credit must be available to cover the amount authorized. Presenting a debit card upon arrival will result in a hold (temporary charge) on your account for the amount authorized. Commission Payments

Kixby pays 10% commission on all nonqualified rates and select qualified rates for stays up to 29 nights. Commissions are paid to travel agents who are registered with the ARC (Airline Reporting Commission) and have a valid IATA (International Airline Transportation Association) number. Commissioned rates include rack/regular and best available.

Credit Card Guarantee

Each reservation must be guaranteed with a valid credit card at the time of booking. In addition, prepaid reservations and deposits will be charged at the time of booking. We reserve the right to cancel any reservation that is not booked with a valid credit card number. Guest must present a credit card in his or her name upon arrival at the hotel. A sufficient amount of credit must be available to cover all room charges, taxes and incidentals. Cash payment will be accepted upon checkout, at which time the credit card authorization will be released. Exceptions may apply during holidays, special events or conventions.

Group Reservations

Kixby welcomes group business, but due to the smaller size of our hotels, we ask that you contact the hotel directly for group reservations. This way, we can do our best to accommodate your group needs. A reservation for 5 or more rooms, whether booked by one reservation or multiple reservations, is considered a group. Groups must contact the hotel Sales Office for reservations in order to receive special services and group rates. Group services are not available if the reservations are booked electronically or via the internet and may be canceled upon the hotel’s discretion.

Parties

For the comfort of all of our guests, we do not allow parties or excessive noise in or around guest rooms and suites.

Dogs, Emotional Support Dogs, and Service Animals

Pets and Emotional Support Animals are not permitted. Kixby welcomes service animals. 

Smoking

Kixby is 100% smoke-free. The hotel reserves the right to charge a $250 cleaning fee if it is determined that there has been smoking in the room.

Special Requests

We will always make our best effort to accommodate you, but please understand when circumstances do not allow us to meet your request. We cannot guarantee any bed type requests made to the property. ADA-accessible rooms are available and can be reserved by contacting the hotel directly or on our website. Kixby meets all of the guidelines set forth in the Americans with Disabilities Act of 1990.

Kixby.com follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. This Privacy Policy applies only to our online activities and is valid for visitors to our website with regards to the information that they shared and/or collect in kixby.com. This policy is not applicable to any information collected offline or via channels other than this website.

The Kixby Hotel User-generated Image Permissions

Persons agreeing to give The Kixby Hotel (the “Hotel”) permission to use their image(s) in advertisements and on the Hotel’s social media channels grant to the Hotel and its affiliates a nonexclusive license to use, reproduce, distribute and make full use of and derive benefit from the image(s). In doing so, those persons represent and warrant that: (i) they have the right to enter into this agreement and to give the rights so granted; (ii) the image(s) is(are) original; and (iii) the use by the Hotel of the image(s) in advertisements or on the Hotel’s social media channels will not violate the rights of any third-party.

Content Posted to Kixby Hotel’s Social Media Assets

Kixby uses a variety of third-party social media websites, communication services and media channels such as Facebook, Twitter and Instagram (collectively, “Social Media Assets”) to communicate and interact with our guest. By posting or submitting content to these Social Media Assets, you represent and warrant that you have the lawful right to transmit, distribute and reproduce such content. To the extent submitted content contains images, you represent and warrant that: (a) you are the copyright owner or have obtained the copyright owner’s permission to use such images; (b) you hold the rights necessary to grant the licenses and sublicenses described in these Terms and Conditions; and (c) you have obtained the consent of each person, if any, depicted in such images.

License

By posting, displaying, uploading, inputting, providing or submitting content to the website or Social Media Assets, you grant Kixby a perpetual, irrevocable, sublicensable license to use worldwide, royalty-free, to copy, distribute, reproduce, use, modify, adapt, publish, translate, transmit, disclose, publicly perform and publicly display the user content (in whole or in part) and to incorporate such user content into other works in any format or medium now known or later developed for any and all commercial or noncommercial purposes.

Kixby Book Club Loyalty Membership Program

Terms and Conditions

Definitions:
•    "Kixby" refers to Kixby hotel, the provider of Kixby Book Club loyalty membership program, located at 45 West 35th Street New York NY 10001.
•    "Member" refers to any individual who has successfully enrolled in the Program, complies with all eligibility requirements, and agrees to these Terms and Conditions.
•    "Program" refers to the Kixby Book Club loyalty membership program provided by Kixby, including all benefits, rewards, and services offered.
•    "Terms and Conditions" refers to this document, including any updates, modifications, or amendments made by Kixby.
•    "You" refers to the Member, as defined above.
•    "Benefits" are defined below under Kixby Book Club Loyalty Levels and Benefits.

Eligibility: Membership is free and open to individuals 21 years and older, excluding Kixby staff members.
Accrual Period: The Kixby Book Club Loyalty Program operates on a rolling 12-month period, starting from your initial membership or qualification date. Benefits accumulate over the next 12 months and reset only after a full year.
Benefits Accumulation: Earn benefits based on eligible stays within your 12-month period. Your status level is determined by the total number of qualifying nights. You’ll continue to enjoy your current status until the next qualification period begins.
Continuous Status Perks: Once you achieve a status level (Novella, Epic, Classic, or Masterpiece), you’ll retain those benefits for the full 12 months. As you enter the next year, you’ll keep your current benefits while working towards the next tier. Some benefits may have expiration dates and that will be made clear on the offer.
Enrollment Information: You must provide accurate personal details (name, birthday, email, phone number). The Member is responsible for updating all personal details and notifying Kixby promptly if any changes occur. Name changes will require legal documentation.
Sign-Up Process: To sign up for the Kixby Book Club Loyalty Program, visit www.kixby.com/kixbybookclub or speak with Kixby Guest Service Team in person, via phone 1-212-947-2500, or via email at bookclub@kixby.com. You’ll be required to provide accurate personal details, including your name, date of birth, email address, and phone number. Once enrolled, you will receive a confirmation email with your membership details.
Account Maintenance: It is the Member's responsibility to keep their account information up to date. This includes ensuring that contact details (email, phone number) and personal information are current. Members should promptly notify Kixby of any changes, such as a change of name or address. Please note that legal documentation may be required for a name change. To provide updates you can email Kixby at bookclub@kixby.com. Failure to maintain accurate information could impact your ability to earn or redeem benefits.
Data Privacy: By enrolling in the Kixby Book Club Loyalty Program, you consent to the use of your personal information for program-related purposes and direct marketing communications. This may include sending you offers, updates, and promotions related to Kixby hotel and any services provided. Your information will not be shared with third parties for marketing purposes without your explicit consent, in accordance with applicable privacy laws. You can opt-out of marketing communications at any time by following the unsubscribe instructions in the emails or by contacting Kixby directly.
One Account: Each Member may have only have one membership account, tied to a single email address. Membership accounts cannot be shared or merged, even within a group.
Non-transferable: Membership accounts and benefits cannot be transferred.
Member Responsibilities: Members must ensure their membership account information is up to date. Any fraudulent activity, such as providing false information or misusing the program, may result in account suspension or termination of the account. 
Eligible Rate Requirement: To earn benefits, stays must be booked directly with Kixby at an Eligible Rate. Reservations made through third-party websites, travel agencies, or platforms will not qualify for benefits.
Definition of ‘Stay’: A 'stay' refers to consecutive nights at Kixby, where at least one night qualifies for benefits, even if some nights are ineligible.
Registration Requirement: You must be a registered hotel guest at Kixby and book an Eligible Rate.
Pre-enrollment Stays: Stays occurring prior to enrollment in the Program do not qualify for benefits or status.
Check-in and Completion: Benefits are earned only if you check in and complete your stay. Benefits will not be awarded for non-refundable fees, cancellations, or no-shows.
Bill Payment Requirement: The bill must be in the Member’s name, and they must pay all charges directly. Charges paid by third parties do not qualify for benefits.
Eligible Rate: Defined as a rate without any discount code, and must be booked directly with Kixby via phone, email, kixby.com, or in-person. Ineligible rates include but may not be limited to complimentary nights, third-party bookings, and contracted rooms.
Meetings/Events: Charges on a group “master account” or “posting master” for meetings/events do not qualify for benefits.
Shared Accommodations: Only the first Member listed on the reservation can earn benefits on the Eligible Rate portion that they personally pay. Other individuals in the same reservation will not earn benefits.
Non-transferable Benefits: Benefits cannot be transferred, sold, traded, or assigned. Any attempt to transfer benefits will render them void.
Benefit Expiration: Benefits have fixed expiration dates and cannot be extended. If not redeemed by the expiration date, they will be void. For stay-based benefits, the checkout date determines the expiration. Other benefits may have separate expiration terms, which will be specified when earned.
Program Changes: Kixby reserves the right to modify, suspend, or terminate the program, its benefits, membership tiers, or available services at any time without prior notice.

Termination of Membership: If your membership is terminated, you will lose all associated benefits and will no longer be able to earn or redeem Program benefits. Additionally, Kixby may, at its sole discretion, prohibit your future participation in the loyalty program.
a.    By Kixby: Kixby reserves the right to terminate your membership at any time for any reason, including but not limited to fraudulent activity, misuse of the Program, or failure to comply with the terms. Upon termination, all benefits and privileges will be forfeited.
b.    By Member: If you request to terminate your membership, the termination will be final and irreversible. Your membership account will be closed, and all Program benefits will be forfeited. No further action can reverse the termination.

Governing Law: The Program and these terms are governed by the laws of New York State. Any disputes will be resolved in accordance with these laws and may be subject to the jurisdiction of the courts in New York.
